  • Be below 21 years of age.
  • Have been deemed to be dependent by a competent juvenile court
  • Be unmarried
  • Be unable to return to their home country or the last place of residence due to fear of harm
  • Be unable to reunite with one or both parents based on abandonment, neglect, abuse, or similar circumstances.

What Is the Process of Getting Special Immigrant Juvenile Status in the U.S.?

  1. Obtain a Juvenile Court Order

A state juvenile court must determine that returning to your home country is not in your best interest and that you cannot reunite with one or both parents due to abuse, neglect, abandonment, or a similar reason under state law.

  1. File Form I-360

Submit Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant, to the United States Citizenship and Immigration Services (USCIS). This filing officially starts your SIJ application process.

  1. Complete Necessary Background Checks

USCIS may require additional background checks, including providing fingerprints and other biometrics, as part of your application.

  1. Apply for Adjustment of Status (if eligible)

If a visa is available and you meet the requirements, you can submit Form I-485, Application to Register Permanent Residence or Adjust Status, to become a lawful permanent resident.

  1. Await Decision

USCIS will evaluate your application thoroughly. If approved, you will be granted SIJ status, and if you filed for adjustment of status, you may receive a green card.
