Special Immigrant Juvenile Status is a program designed to assist children who have been neglected, abandoned, or abused settle in the United States. It also covers children who can not be reunited with their parents. As a special immigrant juvenile, you can get a green card to live and work in the United States.
As compassionate as the Special Immigrant Juvenile program is, it is not an automatic status. To qualify, there are very detailed SIJS requirements that must be met; the applicant must:
While these are key requirements that qualify someone for the program, it is not an exhaustive list. If you need help with understanding the SIJS requirements, you can contact us at Din Law Group, PLLC.
A state juvenile court must determine that returning to your home country is not in your best interest and that you cannot reunite with one or both parents due to abuse, neglect, abandonment, or a similar reason under state law.
Submit Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant, to the United States Citizenship and Immigration Services (USCIS). This filing officially starts your SIJ application process.
USCIS may require additional background checks, including providing fingerprints and other biometrics, as part of your application.
If a visa is available and you meet the requirements, you can submit Form I-485, Application to Register Permanent Residence or Adjust Status, to become a lawful permanent resident.
USCIS will evaluate your application thoroughly. If approved, you will be granted SIJ status, and if you filed for adjustment of status, you may receive a green card.
While these processes may seem simple on the surface, it is not. It is recommended that you speak to an immigration lawyer for guidance.
